A new Department of Justice legal memo is threatening decades of hard-won progress for disability rights.
Under the Americans with Disabilities Act, the rules have always been clear: States must give people with disabilities the option to get care at home or in their communities, rather than warehouse them in institutions.
But this new DOJ opinion flips that script, claiming that states aren’t legally required to provide those community-based services.
It won’t instantly change the law, but advocacy groups and Iowa Senate candidate Zach Mecham warns it basically gives the federal government a green light to stop enforcing vital at-home care protections.
